Während in den Technikwissenschaften teils behauptet wird, der technologische Fortschritt mache rechtliche Institutionen überflüssig, weil Vertragsdurchsetzung zunehmend durch technische Vorrichtungen "geregelt" werden könne, ist das Vertragsrecht in Wirklichkeit keineswegs eine quantité négligeable für die Entstehung von Innovation.
