Auch nach der Reform des Asylrechts ist die juristische Auseinandersetzung um diese Frage keineswegs zum Abschluss gekommen. Vor diesem Hintergrund beschaftigt sich das vorliegende Buch mit der Frage der Vereinbarkeit des Konzepts sicherer Herkunfts- und Drittstaaten mit der Genfer Fluchtlings- und der Europaischen Menschenrechtskonvention. Ferner wird auch die Ubereinstimmung von Art. 16a Grundgesetz mit dem in Art. 79 Grundgesetz enthaltenen Gebot des Schutzes der Menschenwurde und des Rechtsstaatsprinzips untersucht. Schliesslich wird gefragt, ob Art. 16a Grundgesetz hinreichend den Weg fur eine europaische Harmonisierung des Asylrechts ebnet.
