»Jurisprudential Considerations and Comparative Law Approaches to Prospective Proceedings Involving Corporate Sanctions«In any prospective proceedings involving corporate sanctions, there are numerous challenges to be faced, which are considered from a comparative law viewpoint. Among these are, above all, the drafting of a nemo tenetur law for the corporation, both in terms of personal and from an objective standpoint, as well as statutory provisions pertaining to internal investigations (with regard to both the interviewing of employees and the prohibition of seizure) and compliance. The most recent draft of the German Corporate Sanctions Act (Verbandssanktionengesetz) is also considered.
