»Financial Innovation and the Limits of Information-based Investor Protection - the Federal Court of Justice's Case Law on Swaps«The development of increasingly complex financial market products pushes information-based investor protection to its limits. Starting from the economic explanations for the phenomenon of financial innovation, the study examines the limits of the information model based on an analysis of the German Federal Court of Justice's case law on the sale of structured swaps. It is shown that this investor protection model cannot cope with the issues arising from financial innovation.
