Be that as it may, this problem has not yet been solved. This study therefore also addresses this problem, sets out the conflicting constitutional principles and analyses the views put forward in fiscal and constitutional court jurisprudence as well as in the literature before developing a new solution model that reconciles the conflicting constitutional requirements by way of practical concordance.
