»Internal investigations from a labour law perspective with focus on self-incrimination«The author examines prerequisites for gaining information through observatory measures or interviewing employees as part of internal investigations. It is also discussed whether or under which circumstances the information gained can be used in labour court proceedings. A specific focus is laid on the employee's risk of self-incrimination during an interview, whether an employee is obliged to give information and consequences that the aspect of self-incrimination might have on court proceedings.
