The Statute of the International Criminal Tribunal for the Former Yugoslavia

Section I describes the scope of offences set forth in Arts. 2-5 of the Yugoslavia Statute. In this chapter, I will argue that customary international law contains a major part of the modern criminalisation of international humanitarian law fading within the scope of the Yugoslavia Statute. In addition, I shall criticise some of the penal developments established in the Yugoslavia Statute. Section III presents some concluding remarks.
