An analysis of e-discovery under US law from a data protection perspective in comparison to the means of obtaining information for civil trials in Germany and England«The investigation examines the problematic situation of companies that become involved in proceedings before a US civil court and are therefore required to disclose extensive electronically stored personal data during pretrial discovery while also beeing bound to comply with the regulations of EU data protection law. From the perspective of data protection law, a comparative analysis reveals a considerable tension, but not an irresolvable conflict in this situation.
